Spain's Ley 4/2026 Enters Force 23 October: Major Overhaul of Disability Employment Rights

Spain's Ley 4/2026, published in the BOE on 3 October and effective from 23 October 2026, is the most significant reform of disability employment law in years. The law strengthens the concept of 'reasonable adjustments' (ajustes razonables), making failure to provide them a form of disability discrimination. Crucially, the obligation now extends to family caregivers of disabled persons — spouses, partners, and relatives up to the second degree. Sheltered workshops ('centros especiales de empleo') are renamed 'empresas para la inclusión laboral de las personas con discapacidad' (EIDIS), with their 70% minimum disabled workforce rule maintained. The government has one year to draft new regulations for these entities and for alternative measures to the 2% employment quota. For HR teams, the law means an immediate review of accommodation processes, job adaptation policies, and carer leave provisions. It also explicitly incorporates discrimination by association into employment law.
